Oshkosh woman fights apartment company to display American flag

Apartment owner cites policy

OSHKOSH – An Oshkosh woman is trying to stand up for renters’ rights after she was told she couldn’t display the American flag in her window.

“It really showed who we are as a family,” said Dawn Price.

Her husband served in the Army for seven years, but the company the couple rent their apartment from won’t allow the flag in the window. She says she and her husband have had the flag been up since November, but just last week she received a phone call saying she needed to remove the flag from the window.

Price didn’t remove it and got a five-day eviction notice, saying she violated a rule in her lease. Midwest Realty Management owns the complex. Nobody from the company would speak on camera.

However, Randy Rich, the property manager, said in a statement, “Our policies do not allow any type of flags, banners, or political or religious material to be displayed in the windows of the apartments. This policy was developed to insure that we are fair to everyone as we have many residents from diverse backgrounds.”

While it won’t allow individual flags in windows, the company does fly American flags near the rental offices. That’s because the company says it has respect for those who serves for the United States. The federal Freedom to Display the American Flag Act of 2005 states no residential real estate association can stop someone from flying the American flag, but that law doesn’t apply to renters.

So now, Price wants to lead the charge to change the law to include renters.

“This was horrific for my husband and I because he doesn’t deserve to be told that we can’t hang the American flag,” she said.

The couple say they can’t afford to live anywhere else and plan to hang a curtain in front of the flag so it can’t be seen from the outside. That way, they won’t be evicted.
